TERMS OF USE

This Terms of Use Agreement ("Agreement") is entered into by and between you ("user," "you," or "your") and Congress Realty, Inc. ("Congress Realty," "we," "our," or "us"). This Agreement governs your use of our websites, including congressrealty.com, flatfeemlslasvegasnv.com, flatfeemlsdallastx.com, realtorparadisevalleyaz.com, and flatfeemlshoustontx.com (collectively, the "Websites") and any products, services, content, tools, or features made available by Congress Realty through the Websites (collectively, the "Services").
1. Acceptance of Terms
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not access or use the Services.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.
3. Services Overview
Congress Realty provides real estate brokerage services, including flat fee MLS listings, contract support, offer management, and compliance tools. Certain features may require account creation and submission of information such as your property details, contact information, and payment details.
4. Account Registration and Security
You may be required to register for an account to use some of our Services. You are responsible for safeguarding your account login credentials and for all activity occurring under your account. Notify us immediately of any unauthorized access or use.
5. Prohibited Uses
You agree not to:
- Use the Services for any unlawful, fraudulent, or abusive purpose.
- Interfere with or disrupt the operation of the Services.
- Misrepresent your identity or property listing information.
- Post or transmit malicious code or content.
- Use automated means to access or scrape our Websites.
6. Intellectual Property
All content and materials on the Services—including text, graphics, logos, icons, images, and software—are the property of Congress Realty or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
7. Third-Party Services
We may use or integrate third-party services such as GoHighLevel, Twilio, and payment processors (e.g., Stripe, PayPal). Use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, functionality, or accuracy of third-party services.
8. Payments and Refunds
All fees for our Services are clearly stated during the ordering process. By purchasing Services, you authorize us or our third-party payment processor to charge your chosen payment method. All sales are final unless otherwise stated in our Refund Policy.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, error-free, or meet your expectations. Congress Realty disclaims all warranties, express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, Congress Realty shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.
11. Indemnification
You agree to indemnify and hold harmless Congress Realty, its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of this Agreement.
12. Termination
We reserve the right to suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.
13. Modifications to the Agreement
We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of the document. Your continued use of the Services after changes indicates your acceptance of the new Terms.
14. Governing Law
This Agreement shall be governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
